This Privacy Policy (“Privacy Policy”) explains how Hownd, Inc. (“Hownd”, “Company”, “us”, “our” and/or “we”) uses your information and applies to all who use our Web sites – www.hownd.com, www.myhownd.com, www.kidsskatefree.commobile applications, touch technologies, electronic services, social networking sites, interactive features, online services – or any of our described online activities we own or control, including any online activities owned, controlled, or operated by Hownd Affiliates (collectively, the “Site”).  In addition, please review the Site’s Terms of Service which governs your use of the Service (“Services”), and includes, among other things, grants of rights from you, limits on our liability and your remedies, mandatory arbitration, and waiver of jury trial and class actions.  By using our Site, you agree to our Terms of Service and consent to our collection, use and sharing of your information and data, and other activities, as described below.

Exclusions:

This Privacy Policy does not apply to any Personal Data collected by Company other than Personal Data collected through the Services. This Privacy Policy shall not apply to any unsolicited information you provide to Company through the Services or through any other means. This includes, but is not limited to, information posted to any public areas of the Services, such as forums, any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and Company shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

 

Children:

Company does not knowingly collect Personal Data from children under the age of 13. If you are under the age of 13, please do not submit any Personal Data through the Services. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data on the Services without their permission.

California Privacy Rights

If you are a California resident, beginning January 1, 2020 you have the right to make the following requests with respect to your personal information under the California Consumer Privacy Act (CCPA):

  • Access You have the right to request that we disclose to you the personal information we have collected, used, disclosed or sold about you in the previous 12 months. You may submit an access request here.

  • Deletion You can request that we delete your personal information that we collected from you to the extent required under CCPA and subject to certain exceptions. We retain personal information to service your membership, to comply with applicable laws and regulations and other permissible purposes. That means we may not be able to delete all of your personal information. You may submit a deletion request here.

  • Right to Opt-Out You have the right to request to opt-out from future “sales” of your personal information. To do so, please visit our “Do Not Sell My Information” page. We do not sell (i.e. generate revenue from) your information to third parties. However, the law defines “sale” very broadly to include simply making data available to third parties in some cases. In order to provide Services, we do let advertising and analytics companies collect IP addresses, and cookie IDs through our sites and apps when you use our Services. We also disclose personal information to the companies that provide products and services to our members for their own marketing purposes as described above (see “Related Parties” and “Agents, Consultants and Related Third Parties” sections above). After you submit your Do Not Sell request, we may continue to share some personal information with our suppliers (acting as our service providers) that do not constitute “sales” to help us perform advertising-related functions such as, but not limited to, measuring the effectiveness of our ads, managing how many times you may see an ad, reporting on the performance of our ads, ensuring services are working correctly and securely, providing aggregate statistics and analytics, improving when and where you may see ads, and/or reducing ad fraud. Any opt out choices you make will only apply to the specific email address that you provide when making the request.

You may designate an authorized agent to make requests on your behalf to exercise your rights under the California Consumer Privacy Act. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized that person to act on your behalf, and we will need you to verify your identity directly with us. Further, to provide or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law. Finally, you have a right to not be discriminated against for exercising rights set out in the CCPA.

We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests. We will not include employment related information in fulfilling your request.

This Privacy Policy applies only to the Services. The Services may contain links to other websites not operated or controlled by the Company (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that Company endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

Third Party Tracking: We may allow third party service providers to use cookies or similar technologies to collect information about your browsing activities over time and across different websites following your use of the Services.

 

Integrating Social Networking Services :

One of the special features of the Service is that it allows you to enable or log in to the Services via various social networking services like Facebook or Twitter (“Social Networking Service(s)”). By directly integrating these services, we make your online experiences richer and more personalized. To take advantage of this feature, we will ask you to log into or grant us permission via the relevant Social Networking Service.
